These Terms and Conditions (the “Terms”) govern the use of https://oberson-arch.com (the “Website”) and the purchase of the products offered through it (the “Products”), operated by Dana Oberson Architects Ltd, company registration number 515893238 (“we”, “us”, “our”).
By accessing the Website or placing an order, you (“you”, “the Customer”) confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.
“Product” or “Publication” means any item, including furniture, design objects and publications, offered for sale on the Website.
“Order” means a request submitted by the Customer through the Website to purchase one or more Products.
“CPL” means the Israeli Consumer Protection Law, 5741-1981, and the regulations made under it.
By placing an Order you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian, and that you have full legal capacity to enter into a binding contract.
We make reasonable efforts to display the Products, including any descriptions, images and specifications, as accurately as possible. Minor variations in colour, material, grain, finish or appearance may occur, in particular for design and handcrafted items, and do not constitute a defect. Product availability is not guaranteed and may change without notice.
Placing an Order constitutes an offer to purchase the Product subject to these Terms. A binding contract is formed only when we send you an order confirmation. We reserve the right to refuse or cancel any Order, including in cases of suspected error, fraud, unavailability of stock, or a pricing mistake, in which case any amount already charged will be refunded.
All prices are shown in New Israeli Shekels (NIS / ₪) and include VAT where applicable. The total price, including shipping costs and any applicable taxes, is displayed before you complete the Order. Payment is processed through our payment provider at the time the Order is placed. We do not store full payment card details.
Orders are processed on business days (Sunday to Thursday), excluding Israeli public holidays. Processing begins once payment has been confirmed. Some items, including made-to-order or custom design pieces, may require additional production time, which will be indicated on the product page or confirmed with you after the Order.
Delivery options:
Shipping fees depend on the destination area and the type and size of the item, and are calculated and displayed at checkout before you complete your Order. International shipments may be subject to import duties, taxes or customs charges imposed by the destination country, which are the responsibility of the Customer.
Delivery times are estimates and are not guaranteed. We will not be responsible for any delay in shipping carried out by a third party that results from force majeure, strikes, shutdowns, or the Customer’s failure to respond in order to coordinate the delivery. Risk in the Product passes to the Customer upon delivery.
As a general rule, all sales are final and we do not accept returns or exchanges for change of mind or buyer’s remorse, except as required by the CPL or as set out below.
If the Product arrives damaged, defective, or materially different from its description, please contact us at Office@Oberson-Arch.com within 7 business days of receipt, including your order number and photographs of the damaged item and its packaging. Where the claim is confirmed, we will, at our discretion and in accordance with the CPL, repair, replace or refund the Product, and we will refund the amount paid within 14 days of receiving your notice. We may ask you to return the Product, and in cases of confirmed damage or defect we will cover the reasonable cost of return.
Where the CPL applies, you may be entitled to cancel a distance-sale transaction within 14 days of the date of the transaction or of receiving the Product (or the transaction summary document), whichever is later. Where such cancellation is not due to a defect or non-conformity, we may deduct a cancellation fee equal to the lower of 5% of the transaction value or NIS 100, together with any charge imposed on us by the credit card company for the cancellation, as permitted by the CPL.
Please note that, under the CPL, certain Products are excluded from the statutory right of cancellation. This includes goods that can be recorded, copied or reproduced, such as books and other publications, once their original packaging has been opened. Where this exclusion applies, the statutory cancellation right will not be available, although your rights in respect of damaged or defective Products under section 7.2 remain unaffected.
A Customer who is a senior citizen, a new immigrant or a person with a disability, as those terms are defined in the CPL, may be entitled to an extended cancellation period in accordance with the law. We may request appropriate documentation to verify eligibility.
Where a return is accepted under sections 7.2 or 7.3, the Product must be returned unused and in its original packaging, accompanied by the original invoice. To cancel or request a return, contact us at Office@Oberson-Arch.com, stating your full name and order number. Refunds are made using the same payment method used for the original purchase.
All content on the Website and in the Publication, including text, images, design, trademarks and logos, is owned by us or our licensors and is protected by the copyright laws of the State of Israel and applicable international treaties. You may not copy, reproduce, distribute, publish, broadcast or otherwise exploit any such content without our prior written consent. Purchase of a Product grants you a personal, non-transferable right to use the Publication for your own private purposes only.
The company and anyone acting on its behalf shall not be liable for any direct or indirect damage caused as a result of the use of a Product or service purchased on the Website, except as required under the CPL. Products are intended for ordinary use in accordance with their description and any instructions provided.
Any information, text, images or content presented on the Website, including in the blog or publications, is provided for general information purposes only. It does not constitute a professional opinion, advice or recommendation of any kind, and does not replace consultation with a qualified professional. Responsibility for any use of the information on the Website rests solely with the user.
To the fullest extent permitted by law, our total liability for any Product shall not exceed the amount paid by the Customer for that Product. Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law.
You agree not to use the Website for any unlawful purpose, not to interfere with its operation or security, and not to attempt to gain unauthorised access to any part of it. We may suspend or restrict access to any user who breaches these Terms.
Your personal data is processed in accordance with our Privacy Policy, available at https://oberson-arch.com/privacy-policy/, and with the Israeli Protection of Privacy Law, 5741-1981. By placing an Order you consent to such processing.
These Terms are governed by the laws of the State of Israel. The competent courts of Tel Aviv-Yafo, Israel, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without prejudice to any mandatory consumer rights you may have under the CPL.
We may update these Terms from time to time. The version in force at the time you place your Order is the version that applies to that Order. Changes take effect when published on the Website.
